These Terms of Service (the "Terms") govern access to and use of the userjourneys.ai website, application, and related services (the "Service") provided by KSP Studio, Inc. dba UserJourneys, a Delaware corporation ("UserJourneys," "we," "us," or "our").
If you use the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity. In these Terms, "Customer" means the person or entity using or subscribing to the Service.
If Customer has signed a separate master services agreement, order form, data processing agreement, or similar written agreement with UserJourneys, that signed agreement controls to the extent it conflicts with these Terms for the services covered by that agreement.
1. The Service
UserJourneys provides an AI-powered user research and product experimentation platform for product teams. Depending on the plan, configuration, and any applicable order form, the Service may include AI-powered voice interviews, interview analysis, insight reports, product analytics, session replay analysis, experiment proposals, and related workflows.
Some features require Customer to connect third-party tools, customer-managed analytics sources, customer-managed warehouses, or other systems. Those integrations are enabled only when authorized by Customer or described in an applicable order form.
2. Accounts and Access
Customer is responsible for its account, users, credentials, API keys, connected systems, and all activity under its account. Customer must provide accurate account information and keep access credentials confidential.
Customer may permit employees, contractors, and other authorized users to access the Service, but Customer remains responsible for their compliance with these Terms.
3. Subscriptions, Billing, and Cancellation
Self-serve subscriptions are billed through Stripe. Customer agrees to pay all fees shown at checkout or otherwise agreed in writing. Subscription plans renew until cancelled unless the checkout flow, plan terms, or a signed agreement says otherwise.
Customer may cancel a self-serve subscription through the account settings or by contacting us. Cancellation stops future renewal, but fees already paid are non-refundable except where required by law or expressly stated in writing.
Stripe processes payment card information. UserJourneys does not store full payment card numbers or CVV codes on its systems. Customer is responsible for taxes, duties, and similar governmental charges, excluding taxes based on UserJourneys' income.
4. Customer Data and User Data
"Customer Data" means data, content, credentials, configuration, prompts, files, analytics exports, product usage data, code access, and other information Customer provides, connects, uploads, or makes available to the Service.
"User Data" means data, content, and information provided by or about Customer's end users through the Service, including interview responses, voice interview recordings or transcripts where enabled, session replay data where enabled, analytics events, identifiers, and related metadata.
Customer retains ownership of Customer Data and is responsible for User Data collected through Customer's use of the Service. Customer grants UserJourneys a limited right to process Customer Data and User Data to provide, secure, support, maintain, and improve the Service, and as otherwise described in the Privacy Policy or an applicable written agreement.
5. Customer Responsibilities
Customer is responsible for:
- having all rights, permissions, notices, and legal bases required to provide Customer Data and User Data to the Service;
- informing end users about voice interviews, analytics, session replay, cookies, and similar tracking where required;
- obtaining consent where required by applicable law or by Customer's own privacy commitments;
- configuring masking, blocking, retention, and integration settings appropriately for Customer's product; and
- avoiding the submission of health data, payment card numbers, financial account numbers, Social Security numbers, government ID numbers, or other highly sensitive data unless expressly agreed in writing with UserJourneys.
6. AI Features and Outputs
The Service uses AI systems to conduct interviews, summarize responses, analyze behavior, identify themes, generate insights, propose experiments, and assist product teams. AI outputs are probabilistic and may be incomplete, inaccurate, or unsuitable for a particular use case.
Customer is responsible for reviewing outputs before relying on them or using them to make product, business, legal, financial, safety, employment, or other consequential decisions. The Service is not legal, financial, medical, safety, or professional advice.
7. Acceptable Use
Customer must not:
- use the Service unlawfully or deceptively;
- use the Service to collect data without required notice, consent, or legal basis;
- reverse engineer, scrape, overload, probe, or interfere with the Service;
- attempt to bypass security, access controls, rate limits, or tenant boundaries;
- upload malware, secrets, credentials, or data Customer is not authorized to process;
- use the Service for high-risk activities where failure could lead to death, personal injury, or severe environmental or property damage; or
- use outputs as a substitute for legal, financial, medical, employment, safety-critical, or similarly regulated advice.
8. Privacy and Security
The Privacy Policy describes how UserJourneys collects, uses, shares, retains, and deletes personal information. It is incorporated into these Terms by reference.
UserJourneys uses administrative, technical, and organizational measures designed to protect Customer Data and User Data. No system is completely secure, and Customer is responsible for using the Service in a manner appropriate for the sensitivity of its data.
For more information, see the Privacy Policy. Subprocessor information is maintained in our compliance records and may be made available to customers on request or through a published subprocessor page.
9. Third-Party Services
The Service may interoperate with third-party products, including analytics providers, warehouses, voice AI providers, AI model providers, customer communication tools, hosting providers, monitoring tools, billing providers, and source-control systems.
Customer is responsible for its relationship with third-party services it connects to the Service. UserJourneys is not responsible for third-party services outside its control, except as expressly stated in a signed agreement.
10. Intellectual Property
UserJourneys owns the Service, including its software, workflows, interfaces, models, documentation, templates, and improvements, excluding Customer Data, User Data, and Customer-owned systems.
Customer may use the Service only as permitted by these Terms or an applicable written agreement. No rights are transferred except as expressly stated.
11. Confidentiality
Each party may receive non-public information from the other party. The receiving party must use that information only to perform under these Terms or an applicable agreement, protect it with reasonable care, and disclose it only to personnel, contractors, advisors, or service providers who need to know and are bound by appropriate confidentiality obligations.
12. Service Changes, Beta Features, and Support
UserJourneys may update the Service from time to time. We will not materially reduce the core functionality of a paid plan during its subscription term without reasonable notice, unless required for security, legal, or operational reasons.
Preview, beta, experimental, or no-cost features are provided as-is and may be changed, suspended, or discontinued at any time. Support is provided on a commercially reasonable basis unless a signed agreement says otherwise.
13. Suspension and Termination
UserJourneys may suspend or terminate access if Customer materially breaches these Terms, fails to pay fees when due, creates security or legal risk, or uses the Service in a way that could harm UserJourneys, other customers, end users, or third parties.
Upon termination, Customer must stop using the Service. UserJourneys will delete or retain Customer Data and User Data as described in the Privacy Policy, account settings, and any applicable written agreement.
14. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available." UserJourneys disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
15. Limitation of Liability
To the maximum extent permitted by law, UserJourneys will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunity.
To the maximum extent permitted by law, UserJourneys' total aggregate liability under these Terms will not exceed the amount paid by Customer to UserJourneys for the Service in the 12 months before the event giving rise to the claim.
16. General Terms
- Governing Law: These Terms are governed by the laws of the State of Delaware, without regard to conflicts of law rules.
- Assignment: Customer may not assign these Terms without UserJourneys' prior written consent, except in connection with a merger, acquisition, or sale of substantially all assets.
- Force Majeure: Neither party is liable for delay or failure caused by circumstances beyond its reasonable control.
- Changes: We may update these Terms from time to time. Material changes will be posted on this page or communicated through reasonable means.
